Terms and Conditions for Seamless Repeat Patterns
- Ownership and Usage Rights for non-exclusive Patterns:
Licensing of Specific Parts:
a. Certain components or elements within the Patterns provided by WienerMadlDesign may be licensed by extern sellers for incorporation into these Patterns.
b. The Licensee acknowledges that WienerMadlDesign holds the licensing rights to these specific components or elements and has granted permission to WienerMadlDesign for their use within the Patterns.
c. The Licensee is prohibited from extracting, utilizing, or reproducing these specific components or elements separately from the Patterns for any purpose outside the context of the purchased Patterns for fabric printing.
This addition informs the Licensee about the specific parts of the Patterns licensed from WienerMadlDesign and clarifies the limitations on using these elements outside the context of the purchased Patterns for fabric printing.
Ownership and Usage Rights for exclusive Patterns:
- Upon purchase of a specific version and color variation of the Patterns for fabric printing, the Licensee acquires exclusive rights to utilize that particular version and color for their fabric production purposes.
Every exclusive colorway can be bought once (owned) by one person only.
b. The Licensee's exclusive rights pertain solely to the specific version and color purchased and do not extend to other versions or color variations of the same Patterns offered by WienerMadlDesign.
This addition ensures that the Licensee understands their exclusive rights limited to the specific version and color they've purchased for fabric printing, without extending those rights to other versions or colors of the same Patterns offered by your business.
Ownership and ussage Rights for PNG- Files :
1.You can use it for any commercial use, such as iron transfer, embroidery,invitation,labels,mugs,sublimation, pacifier, etc.as long as you don´t claim the ownership oft he properties.
2.You can´t use it to sell art prints.
3. You can´t reuse the clipart für any seamless design.
4.DO NOT resell, sublicense, distribute or share the files to anyone, except for printing purposes.
5.You CAN`T use the images for any Print on Demands and upload it on platforms such as, Red Bubble,Society 6,Teepublic, ETC.
6.You can´t upload the images to any microstocks or other graphic resources such Etsy, Freepik,Adobe Stock, Shutter Stock, Creative Market, ETC.
7. Legal action and comensationfee will be taken for breaking the terms.
8.By purchasing, you agree tot he T&C listed above
2. Permitted Usage:
a. The Licensee may print the Patterns on fabric for commercial purposes.
b. It is permissible to sell fabric products that feature the Patterns without alterations to the design.
3. Restrictions:
a. The Licensee may not sell, share, or distribute the digital files containing the Patterns in any form.
b. It is strictly prohibited to modify, edit, or change the Patterns in any way, including but not limited to alterations in color or elements.
4. Intellectual Property Rights:
a. The ownership and copyright of the Patterns remain with WienerMadlDesign.
b. The Licensee acknowledges that the Patterns are protected by intellectual property laws and agrees not to infringe upon these rights.
5. Licensing and Attribution:
a. The Licensee is not permitted to sublicense, resell, or transfer the rights to the Patterns to any third party.
b. When showcasing or selling fabric products that feature the Patterns, attribution to WienerMadlDesign as the creator of the Patterns is appreciated but not mandatory.
6. Legal Actions:
a. Any breach of these terms and conditions will result in the immediate termination of the license without a refund.
b. WienerMadlDesign reserves the right to take legal action against any party that violates these terms and conditions.
7. Liability:
a. WienerMadlDesign holds no liability for any damages, losses, or consequences arising from the use or misuse of the Patterns by the Licensee.
8. Acceptance of Terms:
a. By purchasing and using the Patterns, the Licensee agrees to abide by these terms and conditions in their entirety.
9. Contact Information:
a. For any queries, clarifications, or requests regarding the usage of the Patterns, contact office@wienermadldesign.at.
10. Modifications to Terms:
a. WienerMadlDesign reserves the right to modify or update these terms and conditions at any time. It is the responsibility of the Licensee to review and adhere to the latest terms.
11. Test and Verification:
a. WienerMadlDesign highly recommends the Licensee to conduct a test the pattern if there is any fealure and to order a sample print of the Patterns before ordering fabric in bulk. Variations in printing methods, materials, or color representation may occur, and it is the Licensee's responsibility to ensure the suitability and quality of the printed Patterns for their intended use.
12. Color Discrepancy:
a. The Licensee acknowledges that variations in color may exist between the digital representation of the Patterns on screens and their appearance when printed on fabric. Factors such as screen calibration, printing methods, and fabric materials can lead to differences in color and appearance. WienerMadlDesign cannot guarantee an exact match between digital display and printed fabric.
13. Design Variations:
a. The Patterns provided by WienerMadlDesign encompass a variety of designs, including graphic designs and hand-drawn illustrations. The Licensee acknowledges that some Patterns may be digitally created while others are hand-drawn, leading to distinctive styles and characteristics.
This inclusion clarifies the diverse nature of the Patterns, specifying that some are digital graphics while others are hand-drawn, ensuring that the Licensee is aware of the different styles and characteristics of the designs.
b: Handdrawn Design:
- All handdrawn seamless repeat patterns ("Patterns") ,Panele and PNG`S provided by WienerMadlDesign are the exclusive intellectual property of WienerMadlDesign.
14. Ownership and ussage Rights for all Designs:

By purchasing and using the Patterns, the Licensee acknowledges and agrees to the above terms and conditions.
Austrian law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
